I grabbed the hammer from the kitchen and hit Jessie three or four times until he was unconscious,
Dude #1 walks into kitchen, grabs hammer, goes back to the living room and beats dude #2 to death.
It's not like dude #1 pulled the hammer out of his waistband to defend himself.
What are you going to do when someone comes into your home, ties you up and attempts to kill you? When you escape do you think you are jsut going to waltz out of the apartment? Do you think the guy will not try to kill you again? DO you have any idea the fear, adrenaline, and emotions that are running through your head during an incident such as that?
Besides all of that it is an apartment. Walking into the kitchen could have been the back room, and the guy could have been by the front door prevent his escape, or maybe he didn't want to get chased and shot in the back.
Then again your probably a person would advise a woman to get raped as opposed to fighting back, because hey you could get hurt more. What if the woman being raped picked up a knife after the rapist was done and killed him. Would you charge her for murder and possession of a weapon?
