It's probably to his benefit not to respond at all, which seems to be the route that he's taking. If he responds and actually resolves the problem by paying you the BTC that he owes, a lot of other users will come out of the woodwork and demand that they receive their missing payouts, too. I have ~2.5 BTC worth of payouts that still haven't confirmed; the first one is from the 19th.
