Thats for a judge to decide not you and not a "lawyer company" Judges have upheld clauses that prevent customers from partaking in class action law suits in the past and that means it would be dealt with on an individual basis and if you or a lawyer think the TOS is moot that's fine and dandy but that issue would first have to be dealt with in court before any class action would be able to proceed, any lawyer worth his salt would know that.
