SEC investigation stuff

Due respect and following the legal advice, but isn't it an "investigation?" And that being the case, are we not misinforming of the situation, which may have negative impact in the world in which we live? People, including us, are splitting hairs between "inquiry vs. investigation."
This version speaks the truth of the scenario:
"Yes, there is now an investigation being conducted by the SEC. As such we can not comment on any active investigation. We are complying with all requests made the SEC and are cooperating and working with them."
Wouldn't this blend be a bit more "transparent:"
"The company is currently responding to an SEC [investigation], and is fully cooperating with the SEC. At this time we have no further comment per company policy concerning ongoing matters of this nature."
I may be misunderstanding based on literal meaning of the word "inquiry."
noun, plural inquiries.
