Note: Alpha is FULLY SOLVENT. Another claimant had 15,000 GBP Judgement and issued a winding up petition against Alpha.

I was actually quite surprised with that result. I figured that they would have moved the money off somewhere else and would then let the company get liquidated. However, it seems like they are trying to keep the company alive - hence they paid me to go away.

As a result, I would suggest that you press ahead with your own petition. I would also suggest keeping this news off the forum, and just communicate if (if you even see fit) to your paid-up members - probably more effective if they don't know that a petition is coming (until your lawyers tell them it will be unless they pay up immediately). Once the petition is served on them, the Court date is set for approx 4-6 weeks in the future.

Also keep in mind that the money you put in to serve the petition:
1. is the first to get paid back if they get liquidated
2. will get returned to you by them if they pay to you go away

I did wind up with some costs in getting the petition withdrawn, and the Court had not assigned me all the legal costs in the judgement, but I came out of the experience with a pretty decent proportion of what I put in.
