Yep, I've seen someone got 50 BTC lost to a brain wallet with blank passphrase and the coins don't got returned...
For me, I will send 90% of the amount back and keep 10% of that (5 BTC) as my commission and rewards
BTW I have once sold something unsuccessfully and I've return all BTC to the buyer (with tx fee deducted).
