Two wrongs don't make a right, but I think people should be able to create fantasies on whatever they want. Might not stop someone suing for damages though. Photoshopping jizz on someone isnt nice either but guess you can't stop people from doing it.

I wonder if Kim Davis could sue the author of the novella using her as a character. I'm doubtful. On the other hand, the U.S. does have a reputation for lawsuits over everything. Who knows.

I think it would be permissible to use a similar, but not exact, character.  Fiction books always have a disclaimer at the front, saying that they are not based on real people or events.  That's not what is being done here.  This is a direct attack on a private person, by political operatives for political purposes.

Look at the summary of the book:

Kim is a simple, small-town woman who finds herself thrown in jail in a dispute over religion and sexuality. She quickly discovers the importance of knowing friend from foe in the notoriously horny women's wing and, with the help of her beautiful cellmate, sets out to learn the ropes.


Let's look at the reviews.  Of course, there are only two, and they read like they were written by the author.

The first and probably last erotic novel I have ever bought. But 5 stars for it being about Kim Davis. A funny book about a laughing stock.

Five stars for the tounge in check play on the idiotic Kim Davis. Regardless of your stance on same sex marriage, there is a beautiful irony in a woman who has been married 4 times to 3 different men and had children from another man while married to her first husband but is against the union of two people just because they are of the same sex. Her supporters are narrow minded and small. One can take a small amount of pleasure in the twist of fate Kim's characters faces.


My opinion?

If Davis had been sent to prison, she'd have been a hero there.

She stood up to the SYSTEM.

Those attempting to ridicule Davis are mean, narrow minded and sick.
