Ok just something for next time: before paying anyone escrow the money to make sure that what the guy is sending you is a legitimate item. I'm not too sure exactly how the NBA passes work because I am not that inclined to watch sports however whatever the item may be that you buy, you must escrow everything to ensure that you will still get the purchase in the end.

Also, while I'll never know the 100% truth I must give my best judgement, and it looks to me like the user Ninjahitoko didn't scam you but is rather an unfriendly guy who is selling these things and because he doesn't have the best attitude you perceived it as a scam.

If he offers no refunds, ask him once and when he says no just say ok. As long as he pointed it out there's no harm done. I understand you wanted the NBA pass today but sometimes things just don't work out - there will be delays everywhere. It would be the same thing if, say, I wanted to read a book with a bunch of friends and so I went onto Amazon and bought the book with "same-day delivery". If the book actually doesn't arrive on the same day it would be sad because I can't read it with my friends but Amazon's not scamming me; they simply have a delay. I would reschedule.

Why not collect the working pass that is rightfully yours (as you PAID) and reschedule with your friends. Again I am not too familiar with the whole "NBA pass" thing but I am assuming it must be something legitimate. Just for future reference: whenever you are still waiting for a purchase to arrive from a vendor never go crazy calling scam like you just did. Collect facts and be reasonable. Plus if he's selling something, he'll probably have other customers to help and will be busy.
