The primary established mechanism for safe softforks is the reserved script NOPs (which will not be relayed or mined by unmodified software today)
If a fork makes a previously illegal opcode legal, how can it be a soft fork?
Good Question - maybe like the issue with being pregnant or not, and trying to skirt the issue by saying it could be possible to be sort of a 'bit' pregnant...
But I am not technically qualified enough to make authoritative statements about details of bitcoin protocol.
