Ok thanks guys I was bypassing newegg and going straight to gigabyte I have had better luck with that in the past but I will try going through newegg.

FWIW they contacted me back and said that if I could provide a receipt then they would RMA but I bought from craigslist and he said that he didn't have one so I was just going to try and find one.
