They could already acces the ICO funds if they wanted to because when forging started according the escrow rules they could acces it. But in order to avoid taxes they won't touch it untill their nonprofit organisation has been made formal which take a few weeks. Otherwise they would have to pay taxes of transferring from escrow to them and them to the company.
