You can't explain which is true. None of them are false, because of how bitcoin works, but you can't prove that either is true. It's P2P, so not everyone will get the same transaction at the same time.

None of the transactions were double spent? Why would someone post the txs to enter your contest, in public, and then decide to double spend it? Why would he not double spend it when you said that he wasn't going to be paid? Spending an unconfirmed input doesn't mean double spending, and in his case, it meant he wanted to make multiple bets without waiting for the previous to confirm, with only 1 input in his wallet.
