I think you need a lesson on what is considered a double spend.
When I receive some BTC in my wallet and its unconfirmed, I can still send that BTC to my friend, he will get BTC and while unconfirmed he can send it to his friend.
All 3 will appear on the block chain HOWEVER until the first transaction confirms, the rest will be unconfirmed also.
This is what happened with that guy who you called a double spend cheater, he received BTC and bet it immediately but since the original transaction didn't confirm yet, it won't confirm your bet.
