You can take the money, if, you can fight your conscience, because taking all that 40 bitcoin and transferring it all on your bitcoin wallet is really not a good idea. I know that we needed money but taking it just like that is really not necessary because 40 bitcoin is not that easy to earn, it will take some time for a person to earn it, so, if you want money, PM whoever the owner of that bitcoin wallet, and tell him that you just found his bitcoin wallet address, and in return, because of your good deeds, who know he might give you 2 bitcoin.
How did you found it ? Using the block explorer, or on a hard drive ? If it is on a hard drive, yes you can take it, lukcy you ! If it is on a block explorer, you can not, since you do not own the private keys.
I don't understand why you will need the private key, OP said that he found a bitcoin wallet with 40 BTC, so obviously, he already been inside that wallet and saw the amount on it, also, he can do whatever he wants on it. He will be just going to need the private key, if, he just have heard to someone that, that bitcoin wallet do have 40 bitcoin, so, if he wants to hack that bitcoin wallet, private key is needed.
