Time for a lawsuit anyone?

I didn't even buy any bitcoins through BitInstant, just needed them to transfer my funds from Dwolla to Mt. Gox. It's been about 27 hours now for me with multiple e-mails and PM's and I've received absolutely no response at all. 500 dollars just gone, with more money lost by the minute thanks to the rising market. 500 USD is alot for me and I'm not letting this go.
