No that is pretty fucking sketchy to try and excuse it by saying there's a note in your site's footer.
If you host stuff for free, and people want to donate they can leave tab opened.
If they feel you are raping them they can just close tab in browser LOL.
That is no hidden malware installing without your knowledge on your PC...

that screenshot is showing that owner of www even didn't read API.
you can start miner with f.e. 1 thread, so it is not using 100% of user's CPU, and isn't disturbing normal work.
If he would do so, you wouldn't even realize it is running ;-)
