The thing is, he tried to. Since the issue popped up during the TME days he was in contact with them and they didn't offer a way out. That was about a month of waiting. For whatever reason they've decided to wake up now.
It would be easier to make peace vs burn a bridge. Plus I bet they could work out some kind of agreement to get ELIX listed there and easily convert and dispose of TME.
