Bitsyncom offered full refunds to everyone. If you didn't take the refund, now isn't the time to bitch. You made your choice. 
They also said that shipping begins on monday - didnt happen.
I don't think you have evidence of that. Such evidence could be, for example, a photograph with GPS info of them sitting in Beijing.
What we do have is "lack of shipping documentation."
