Why not just couple the two into a single hardfork? When you go to change the algorithm just denote bad transaction flags to the addresses.

After talking with pool operators, they have made it clear they will not support a fork to ban the 40k.Weren't some of the pool devs apart of the original dev team? So it would make sense that they don't want a hardfork if they were the ones with the coins?
Our consensus is to not create an explicit fork for just the reason of banning the coins. Coupling the implementation of the algorithm and banning all those coins is possible but there are reasons against doing so because it sets a bad precedent and it might cheat paying users if those coins make it to an exchange.
I also want to make it clear that no pool owners are a part of the development team.
