FTC's mail order rule, you're only granted a refund if the company fails to ship within the stated timeframe.
KnC says they'll deliver within September. So we're only allowed a refund if we haven't got any machines by october.
And aside from that, the FTC has zero say in this, since KnC isn't located in the U.S.
Serious question, can OP be considered the "company" if the machines aren't up and running by october-ish? He could get the machines on time but not start giving us our shares until later than he promised. If that happened, we'd be entitled to a refund, no?
