Well, if there's ever a legal injunction, it would be interesting to see how they'd seize the coins. 
they could possibly just sue the creator?
get his identity from bitcointalk.org with subpoena.
directly hold him responsible?
that is unless he took some steps to hide his identity, we'll never know.
