Any invoice over $1000 is flagged by customs and subject to import tax.

I was going to use the same argument in my case, but it's already been to court. The ruling stated that because ASICS cannot be programmed by the end user they do not qualify as automatic data processors and are subject to the tax. This even applies to the Baikal units that can run multi algo.
When I ordered my Z1 they only invoiced me for $150, so no tax....
