I didnt stake them ... is there any way to recover them ? cryptsy will add it or it is lost ?

On the blockchain that you are currently on, I really don't think there's much you can do to get them back (assuming the transactions have been confirmed). That's just the irreversible nature of cryptocurrency.

The way I see it, there's three ways this whole situation could be resolved:

1.) Cryptsy starts working with The_Catman to get us all on their blockchain, in which case all missing CENT sent since the fork will be recovered.

2.) We stick with the current block chain, as everything aside from transactions to Cryptsy seems to function very normally. Unfortunately, for Cryptsy, there will be a considerable mess to clean up on their end, since the CENT/XPM market has been open for more than two weeks on a forked blockchain. There's going to be plenty of people extremely happy that they got XPM for free, and just as many wondering what happened to their Pennies (basically, I go and trade my pennies for XPM on this blockchain, the blockchain switches, and I have all my pennies back and they guy I traded with has nothing and no way of recovering his money).

3.) We end up on yet another blockchain separate from Cryptsy's and the one you are on. Considering the amount of confusion as to who is on what chain, this might be a possibility if you are not at present synced with the standard chain in use, say a month from now. In this case, you will also recover you Pennies.

It has been pointed out a few times already...

There are probably MANY of us on the same chain as Cryptsy... this is not the issue...

It seems if you are sending from any inputs with a date AFTER the Jan 8 cutoff, they will not go anywhere... but people here have confirmed a few times that sending coins from inputs OLDER than Jan 8 are arriving at Cryptsy just fine.

Cryptsy has confirmed a few times that they were on 10.0.0 beta and when asked about these newer versions... were more than happy to update further.

I feel like the majority of the deposits not making it to them has more to do with the stake change and recent updates than the chain itself... although i am sure that is wrong and it is something do to with the chain and stake and nTime stamps... i just don't know anymore...

Yesterday, The_Catman sounded rather confident that we are not on the same chain as Cryptsy. This would seem reasonable, since a fork would most definitely cause a distinct break in the system, and prevent transactions from going through. I'm not saying there aren't code issues (idk if it's even relevant, but The_Catman has not addressed dragon695's question about it), just that I don't think we're synced with Cryptsy. Please correct me if I'm misinterpreting something.

Yes, I'd given up trying to get in sync with cryptsy as they seem to be blocking direct client connections and refused to respond to any of my inquiries.
It's their responsibility to make sure they're in sync with the proper chain, not mine. If they refuse to actually do their job they can deal with the mess on their end.
