Have you heard of the howey test? Even if you state that your token is not a security, government may still see it as a security since it promises a return on investment. Granted the howey test applies to US law and EU law may be different but please get some legal advice regarding your token status.
And since the token is not registered under ESMA is there a company who is issuing the tokens and under what jurisdiction are the tokens issued?
