First of all even if you search for HDR Global Trading Limited (which is bitmex) with the same link you shared you also wont be able to find their presence. According to your logic bitmex is also a scam.
Probably they copy-pasted part of T&Cs of bitmex because its a very similar business and they decided to use the know how of established player (hey, many do this) and btw T&Cs and other policies are still different
