That's not entirely true.  Here's one ban that was successfully appealed, and recently theymos only gave another member a temporary ban for plagiarism.  Mostly it has to do with the value of the user's contribution to the forum, and if they're deemed "net positive" to the community.  Unlikely in this situation, but not completely unheard of.
