The problem will not be solve here if both parties will not agree, if you believe you are right, go ahead and make a scam accusation if you haven't yet.
I think the player did something wrong and for that reason the player got refund deposit amount only. In this case if the person make anything unethical or abuse any system then scam accusation will not be helpful for that person. And that is why the person not creating the scam accusation and personally I don't think the site has did any scam.
