The scam was supposed to work because the victims had supposedly signed away their rights by acknowledging that there was no guarantee for the services provided. Of course, such a contract is illegal, but a scammer counts on his marks not being smart enough to recognize that and just think "Oh shucks, at least they tried" when they never did.
