Someone already file a lawsuit against Bittrex for holding his funds. Funny this is according to the New Yorker, she was asked to sign a so,ewhat like a waiver not to sue Bittrex. If the claim is true about the waiver then maybe Bittrex did something wrong that a lawsuit can be filed against them. Read here

Such an easy way to undo yourself from all responsibilities. Waivers like these seem extremely unlawful to me, especially when we are talking about exchanges that's trying to receive licenses from the US government. I really doubt it holds up in court.
In many cases you can sue even if you SIGNED a waiver, let alone if the waiver was included somewhere in the TOS.
IANAL but i'd be interested to see if bittrex can actually legally enforce such clauses.
