Fairlay is not really a book, it is a market. You bet against other people and rely on the math of the platform to work out for you. So ok, in that sense, it is the smart contract (or whatever code) that is the one that determines everything,,, but trust me if you try to double spend on Fairlay you will equally get outsmarted and confiscated!
