It is layer 2.
It operates on top of Bitcoin, ergo it's a layer.
LN is a separate network. when handshaking peers on the LN network. you are not at that point subject to bitcoin. you can then set channels that used locked pegged coin (that never leaves the bitcoin network) and you then transact on LN using millisat tokens begged at 1sat:1000msat.
but LN is not transacting btc because btc does not leave the bitcoin network
