I personally do not think coinmarket.io was established as a scam.
As the GitHub link below shows, 2 months ago a security breach occurred. Bitcoin was obviously lost.
The biggest problem Kiur has is the same as Mt Gox: He continued to run the exchange in the hope more coin deposits and fees would make him solvent again.
I've always thought that it was possible, even probable that the site was started in good faith and that due to either hacking, major tech problems, or general "in over their head" issues, the exchange guys lost it and decided to run.
Regardless of initial intent, their behavior is now well over the line and into criminal territory and must be dealt with as such.
