Safex has no wallet, the wallet that Safex uses TWM is a wallet from another company owned by Daniel Dabek with the name of The World Marketplace, Inc. So there is no court ruling that can stop Joey from using or forking that software and use it in Safeth.
He can fork Monero and TWM wallet, and if Safex or The World Marketplace sue Joey again it will lost because of the software licence that says its opensource and anyone can use it or modify it.
But again, I don't think Joey will do that because he don't want to be associated with Safex because is a scam.
