We can't point one finger to one entity without thinking that there are other entities that possibly could be working with them.
Isn't there an update for the Lightning Network that makes it impossible to distinguish between a regular Bitcoin transaction from a transaction that opens a Lightning channel? That could be a solution to help preserve Bitcoin's fungibility.
