Hmm... I have to say I find it quite frustrating that the name rung a very distant but familiar bell in my mind, yet I can't grasp it, that I've read their name somewhere sometime ago, but I can't fish that information.
Given I roam mostly on scam accusations, I thought I must have read their name on this board, on a case raised against them in the past. But I can't find it on my list. So I assumed the case was before 2023 [as my thread only list cases from 2023 forward], but searching high and low and deep and wide... and old, I can't find it.
Maybe my mind is tricking me... deja lu, much?
Anyway, reading your supporting evidences [with some difficulties as imgbb hates me], I think it's safe to say that the platform wronged you by holding that long and paid in installment because they uhh... underachieving. I can [probably] understand if the delay was because an investigation asked by their provider, and this was my initial thought too as I read the first part of your narrative.
But upon progressing with the story and they told you that they have to pay in installment due to their issue with their finance, it was clear that the issue was not with the provider asking to froze asset for investigation following a big win. I think it can be safely considered as a breach of written contract as they did not fulfill their own agreement with you to pay monthly.
Yes, I've read their tos, and they actually have a clause that allows them to pay in installment [which, reading it, I found myself surprised], but upon failing to complete that obligation, as shown on the image below, they breached that contract with you, that warrant them at least a type-2 flag and actually applicable for type-3 [breach of written contract] as they did have it in writing.
If you raise one, I'll give my support to the flag if there is no answer or any movement worth mentioning from them three days from the day you raised it.
albon, since you're in contact with them, do you mind to bring this to their awareness and kindly ask them to do something to put things back in motion within three days? I noticed that their account here is [as you've also concluded] simply for promotional purpose and will not handle cases, thus PMing them will be a waste of breath. I can try to reach them, but given you're already in touch with them, that'll safe me a lot of time.
Hi @holydarkness, thanks for your support. I’ll wait until the end of the week since they mentioned they’d update me, but honestly, I don’t expect much.
Their terms state: 3.4.5. In case your winnings are $50,000 or more, HunnyPlay reserves the right to pay the winnings in equal parts until the full amount is dispersed. At the time, my winnings were approximately $38,000. Even if they decided to pay in installments, 5% per month is completely unreasonable given the volatility of cryptocurrencies. Any reputable casino should be able to pay out an amount like $38,000 without issue.
It seems like they’re acting in bad faith, possibly hoping I’d keep playing and lose everything. This has happened before to someone else in a similar situation. He withdrew 58 ETH but got frustrated with the delay. When he asked the VIP manager to cancel his withdrawal, they allowed him to keep playing, which led to him eventually losing it all. He managed to win back 11 ETH, but he’s still waiting for his payout too.
Additionally, I don’t think there should be any financial issues on their end. I tracked their contracts and saw that they withdrew over $1 million in USD across multiple chains to Binance.
