In other words, they can but don't want to suspend the domain because they don't believe it's malicious enough. They want a legal entity (law enforcement, court,...) to get involved for them to act.

The point is that taking down a lookalike domain that is used for phishing is one thing. Another thing is to take down a domain because its content contains links that lead to fake websites. This is very complicated. It will be very difficult to take down these domains for this reason. These cases normally only occur with legal action.
For these two domains, the strategy has to be different. It will be easier to take down the site by contacting the hosting company. Although this is not the main idea of eXch, in these two cases I think that is as far as you can go.
