You are missing the fact that they are free rolling him by taking his money in the first place. They clearly saw that he was from Spain since he didn't hide his IP. Yet they happily accepted his deposits knowing if he wins they don't have to pay and if he loses it is what it is.
If you play at stake for example and you are from a banned region (according to their TOS) you instantly get a message when opening the site that you can't use the site from there, that's how it's supposed to be.
The way they handle it opens the door for this kind of free roll scenario, which really is scammy. Of course it's OP's fault since he didn't read the rules, that's no question. But I am sure razed knows exactly what they are doing there, this clearly is intentional.
I do believe there are many cases like this out there and usually players are the one who get the loss. For me, the most fair solution that the casino should give the whole deposited money back, it should be calculated by how much the total deposit and total withdrawal made by the players so far. Or in other words, there is no side take an advantage against each others. There can be an exception for the casino to forfeit winnings even the deposit from the players, it is if the players realize that they are coming from restricted jurisdiction but they are bypassing it by VPN. I have to agree if casino warn players earlier even before people try to register an account. I am sure casinos can implement a system to detect where the visitors come from so it may avoid this kind of situation. Once visitors are warned earlier but they force themselves to register-deposit-play, the casinos has the right to do as what the terms they have.
