I wonder for what reasons they can go to court? These are the rules and they were known in advance.
I think the situation can be resolved in the same way as it was done with Girona (which also shouldn't have got into the Champions League as they belonged to the same group of owners who own City). They just have to change the ownership structure to formally comply with the rules, that's all.
