Doesn't Paypal state in their user agreement that all disputes must be handled through "arbitration" and that by agreeing to the user agreement you revoke your right to sue them in a court of law?

Good luck, it's hard to win a case against a big corporation. Corporations like Paypal own the US government.

Yes they do, and thats why we needed a judge to rule that he would hear the case in open court. On the principal that this is not a small claims case as it is WELL over $5,000, and furthermore as this case has criminal actions.

The reason Paypal binds that arbitration is because they know that a lot of what they do is Illegal and if it ends up in a court room ( which is very very very very rare ) they just try and buy the prosecution off with a minimal stipens and slap them with an NDA. The difference here being, we are not just seeking compensatory and punitive damages. I do not have a "buy me off" value and will NOT be signing and NDA unless paypal is FULLY held accountable for their criminal actions.

This isnt about money, anybody who knows me personally knows that the bitcoin i hold is more than enough to live off for 4 lifetimes. Even if this entire lawsuit goes array, i have decided personally that here and now is the time paypal starts having to play by the rules, and if needed i will still continue to lead a massive movement against paypals criminal actions. Just in the bitcoin community alone i have been contacted by WELL over 1,500 people now who have almost the same experience with paypal.

Its the same principal as doctor assisted suicide. Killing another human being is a crime, just because they sign a piece of paper agreeing "hey, its ok to kill me now, i want to die" does not make it legal as many courts have ruled hundreds of times. Its the same with paypal. 70 % of their standard business practice is illegal by charge of the FTC, SEC and several other regulatory bodies. Just because you check a box saying you agree to let them treat you with disregard to the law, does not make it legal.

Thus far paypal has been able to buy off anyone who challenges them, but most people who challenge them are opposing over a few thousand dollars, so when paypal says "fine heres your money, but you sign this NDA first" people just take it as they know they have not the financial means to continue to peruse paypal. I on the other hand have a great legal team who actually to this point have refused to take any more money from me, and even if it gets to the point i need to pay, i can go toe to toe with paypal for a VERY long time as a result of all the wonderful life changes bitcoin has brought me.

paypal after all has not made a profit a single year in business yet, and the only thing keeping them afloat is ebays seller fees.

For the rest of you who want to repeat the same post over and over:

I am well aware paypal is probably following this thread with a fine tooth comb. But with that, they are also aware that i have thousands of people who want to take action too, and even though we cannot combine lawsuits into class action, they are aware that i am not going to stop and that even if i lose thousands of people from the bitcoin community alone are going to have someone to help them, and lead them into their own actions as a group. Not to mention how many people will stand up against paypals illegal actions once they know there is a group leading a charge against them that are not part of bitcoin.

In summary: The crime that has been allowed to continue for a decade now will stop here, and it will stop now. WE WILL TAKE A STAND even if i lose. you can silence one or two, but you cannot silence the masses.

I wish you luck buddy. I've lost out on 7BTC that I sold on eBay a few months ago. They revoked my paypal account and took my money. What I don't understand is if it's against the Paypal user agreement, why do they allow you to sell Bitcoin on eBay? Given that eBay owns Paypal. It makes no God Damn sense at all. It seems like they are willing to charge you seller's fees but not let you keep your hard earned money. That is fraud, plain and simple.

You never mentioned why Paypal suspended your account. I am assuming you were selling Bitcoin on eBay?

So what about Batch 1 and Batch 2. Doesn't seem like any were delivered other than broken pieces of shit. So where are the refunds for those batches? Why is Yifu getting cold feet about pocketing the money for these chip orders, is it because he thinks he could run into legal difficulties?

It's not a scam as we all know it is tremendously difficult to design a black box and then make unsubstantiated claims about it. It is also extremely difficult to fabricate black screens with text on them.

Unfortunately the stream of idiots is in fact drying up as pre-orders for BFL products aren't selling like they use to on ebay, which means people are getting wise and the suckers who have been conned don't have enough money to be reconned.

Sure FPGA have been shipped but that was just to set up the con. Produce a viable product, which adds  credibility to your operation, then offer an extraordinary product with an open ended "delivery date" insert a few shills who have gotten their "product" and keep the scheme going for as long as possible.

You idiots who got conned will find out in a year or two that the only thing you have to show for the money you spent is a piece of paper from BFL which will serve as a reminder of your idiocy.

I've been selling on eBay since 2000 - this is a bad idea. Paypal transactions that are digital based (gift card codes, iTunes codes, BTC) have no recourse for a chargeback.

You will almost certainly be the victim of a chargeback

No less than 1/3 buyers have charged back after paying with Paypal. I guess that's why they don't mind paying $220+ per bit coin and paypal always sides with them.

you realize that by asking people to pay as a gift on your listing, you are in violation of ebay policies right?  I'd be surprised if some of these aren't investigated and you lose your ebay privileges...

I'm accepting Cash for Bitcoin. When ebay says they wouldn't let you use cash as a payment method. Based on my experience ebay doesn't give a shit as long as your making them money.

This is not true.  PayPal is reversible.  It doesn't matter how it is funded.  Do not accept PayPal payment unless you trust the person not to reverse the transaction.

This.  Regardless of funding method, it is reversible.  CC is just easier to do since the CC company will say screw PP if PP declines to chargeback and the CC will chargeback anyways.  But PP has its own chargeback mechanism and even if you pay with bank account or PP Funds, you can still chargeback if you dispute with PP and win.

I'm selling Bitcoin at a discount of $160 per coin. Payment must be made in US Dollars. A lot of Seller's successfully sell their Bitcoin for over $200 but dealing with Paypal and scammers is a too much of a hassle.
To Paypal and Ebay Bitcoin is akin to Voodoo. Your 90 year old Grandma probably knows more about Bitcoin than your average Paypal or Ebay customer service rep.

I have 100% positive feedback and have been selling for 6months.

It was PayPal's policy to not act as a currency exchange service even before BitCoin came around. This is not a new policy.

The odd part is why eBay is still allowing the sale of BitCoin when it is against PayPal's policy. They could easily restrict the sale on the auction site.They are the same company.

It generates Money for them and that's all they care about! Angry

Why is Ebay and Paypal so Technically Retarded When it comes to BitCoins? Why can't they have a Seller and Buyer protection policy for BTC? Why can't they figure out how to systemize the sale of Bitcoin through the Block Chain Info? You think with the Billions they have in $$$ they can hire and/or train people to be Tech literate.

I'm pissed off because someone pulled the Charge back scam on me today. And Ebay/Paypal always side with the Scammers no matter how much proof you have. I had proof stating he received it in email, block chain proof, all kinds of proof yet nothing is ever good enough for those people at Ebay!!!

 Instant

When people pay you via Paypal it shows that field at the bottom of the page.

A Question About Paypal Gifts Where it says "Payment type: instant" does that mean it was funded via Cash and not Credit Card or Bank transfer? I'm asking this question because I am using Paypal to sell Bitcoins. And am worried about fraudulent disputes where I send buyer Bitcoin they say the never received it and I end up losing my money since you can't prove delivery of Bitcoin with Paypal as they are ignorant about how Bitcoin works.

However I am aware that Gifts are irreversible if funded through current account balance and not Credit Card or Bank Transfer.
