On previous refunds for Bitcoin Miners KNC choose to pay back the amount written on the invoice.
If they now choose to do this differently, it looks to me not only as unserious business, but systematic fraud.

Interpreting the law the way the business can choose what to refund, any business could offer a "dream" product. Then wait for payments in other currencies. And some months later, compare the exchange rates and decide which currency to refund - whichever is worth less.

Is it time for Mini Titan Batch 2 customers to consider forming a class action lawsuit against KnCMiner? Batch 1 finished shipping last year. We are well beyond the advertised time frame for delivery of batch 2. Has KnCMiner engaged in deceptive advertising? 

As i recall, that promise was part of the product details in the store. Therefore it's part of the contract.
I don't recall an advertisment of the +1 month outside the store? Was there, too? - that would cement the case.

True, i also ordered one Titan - at the beginning of June 2014 (!!!). Now is February 2015. The delivery time is like with Butterflylabs. Untrustworthy.
But while Butterflylabs didn't promise delivery times, KNC did. They wrote the batch 2, would be 1 month after batch 1.

So they are worse than Butterflylabs, cause they're also not keeping to their contract. This is a legal issue. Everyone not having received one Titan batch 2, within 1 month after batch 1 is eligible for legal action against KNC. Lawyers have easy play with contracts not being kept. With a contract there's not much arguing.

But i'm afraid it won't help, that the contract hasn't been kept. Since they invested big in mining, i think they had to take debts to finance them. And since the bitcoin prices fell those investments are worth to null. Now, if they order a new batch, and need to pay for it they would have to take more debs, and if the bank refuses, they can't.
When they run out of paying their employees salaries they will file for bankruptcy and say, they couldn't have seen it any earlier. If they do that, remember my post then.

All we will have from Titan batch #2 orders is a claim in the bankruptcy proceedings.

KnCMiner is going to stop selling miners to “unhappy customers” and will instead focus on mining themselves.

“When we don’t have these customers buy our hardware it becomes a different business model. It becomes much easier, much more open, much more honest,” Cole said in a phone interview. “There’s still going to be $2 billion, at today’s price, mined in the next few years. That’s a lot of cash that’s up for grabs, and we’re going to do our best to take a decent chunk of it.”

Their production costs are much lower than the price tag on any of their machines. The pricing for their customers probably includes R&D plus an extra. Their own machines they buy then only at production costs. Therefore they themselves make cash, their customers not. No wonder their customers are unhappy. They got an unequal deal.

More reasons to be unhappy:
1) KNC finds loopholes in their promises, i.e. Titan Q3 delivery is "we ship the first unit in Q3, the rest goes in Q4..."
2) KNC has preorders without refunds, plus a pricing for a MH/s value that at the time of delivery is far too high
$10.000 Titan customers earn now less than $ 30 a day - no discount or MH/s upgrade. And
3) if that interviews correct - Cole doesn't like "these" - who is meant by these? - all?- customers and regards them (or at least life with them) as dishonest?

Probably it makes sense not to offer customer products any more. Not because of dishonest customers, but because honest customers will not buy at a company that has a destroyed reputation like this.

It would be good for KNC to once imagine themselves as a customer being treated like this and see it the other way round. And then think again what they would expect in that situation. KNC did a good job when they started. Since then, it started with the upgrade promises for the slower bitcoin machines which they couldn't keep, then their late Bitcoin, then their late Litecoin miner with 3 months delivering. One goal shot, three goals received. If it'd be a football team: Time to change something.

I bought my 3 KNC Titans in june, but they just got produced today, after several months, and the LTC is already in 90USD/day with the 3 machines, what could i do???
Does the Titan mine Scrypt-N?
And what is the hash for that???
Can someone send me a tutorial for setup?
I am going to pick them in sweden next week...
That means that they are delivering now since 3 months??? Titans: September, October, November.

And they promised delivery in Q3 - haha. They've become completely unreliable - like Butterflylabs. They spend it on big datacenters while milking their customers and leaving them with vast losses. Not a fair deal. Not a fair behaviour. Not a fair company spirit.

yep, by now they behave like Butterflylabs. They also kept delivering for months.

unreliable. I agree, beware.

Due to their huge other investments (Mining farms), they could also be close to bankruptcy and can't afford to pay their suppliers any more. Lets hope we even see some miners.

yeah maybe ....my timing sucks..KNC's rep went to hell starting 1 wk after i got the Titan....jeez

but yeah I'm stuck with the Titan

as it is now it is pretty clear anyone with 5k or some such should just buy btc on the old (can it be old if btc born in 2009) the ''old' adage...anything UNDER 1k per bitcoin will seem like a 'deal' in 2 years....or the *we shall not mention crosses self* alternative of bust in 2 years

one or the other (at least my splat will be bigger then most if we all fall from 'orbit" neaha neaha)

yeah, no refund for the Titan - it's easy to guess why. Neptune was fucked up and people used refunds. With a Titan you're stuck forever with the pre-order. Investing in Bitcoins themselves has become more lucrative than hoping for good miners.

If you're bank director, known to be regular looser of big sums in the casino, claim your bank has been robbed and your neighbour finds part of the money in your garage. You state then that you found it first and report it being found in your garage.

Which investigator believes that story? Even lets him stay bank director. I am continously surprised by the lack of any action or hearing anything from the Japanese side. Bankruptcy protection shouldn't be a free "Get out of Jail" card and "keep all you stole".

The coins are now in several hundred new addresses with 300-2000 BTC each. If it's actually using the splitBigOutputs() function they should end up in 30k different addresses holding less than 10 BTC each.

the more the coins are handled the more foot/finger prints are made visible and the more connections could be made

for example, in order to mix you must go to a mixer their computer records will show the coins going in by x isp at y timestamp

that mixer will either cooperate or be materially embroiled in a criminal investigation

now with that isp as the finger print you could look for other places where that isp has engaged other mixers, exchanges, etc ...

eventually the electronic finger prints and foot prints will lead to humans who will need to explain.  If the prints are MK, MG employees, and or relatives of either arrests would be.

AND, whatever "mixer" it would be - it would have to have an at least about equal amount of BTC at the time of mixing to be able to cover any tracks... If 200K + 1K per day go in and 201K go mixed out, this is quite traceable, too.

What would make sense now are only two scenarios:

1) MTGOX had encrypted the keys and couldn't decrypt them any more - now checked all possible decryption scenarios until one worked. Now - to avoid having an "all in" scenario again - they decided to split them and handle each wallet with a different security.

2) The Bitcoin transaction in 2011 was a transaction by someone close to MTGox did them a favor to proclaim liquidity. When he now found out that his wallet is under suspicion, it gave him the creeps and he moved them to several others.

3) The "thief" theory is - reasons already mentioned above - off the table.

well yeah, and the big time fraud theory by someone from MTGox, believing authorities will be unable to ever catch him - i hope at least not.

There was some irc chat long ago, where Karpeles sent around 424k BTC to a particular address as in to prove that the exchange holds enough funds.

omg!!!. - not allowed to tell her name, whether she is working for MTGOX, has NO manager(!), doesn't know anyone from MT.GOX, can't say what Bitcoins are and is not in a call center, ..... she can tell that she is in Japan (hurra!), near the Japanese sea, but not where in Japan.... Wink - Poor girl, though, hired to play stupid: Mesa Jar Jar Binks! Mesa know nothing!

My call wasn't that bad. She could at least tell me the posted 3 points - looks like they're allowed more by now.

What the MTGox Callcenter has to say

I called them today and wanted to know what can be done now and if there is any information. This is what i found out:

1) They confirmed, that they are under official supervision (i asked for the current management, so this tells me the same management is still in place, but they are being supervised)
2) They told me there's nothing anyone can do right now. (I explicitly asked if getting a lawyer is now necessary).
3) They told me there will be a new announcement today on the website (which is online by now, but tells nothing more anyway).

By checking the website i noted, that the callcenter in english language was removed: Its number is(was?): +81 3 4588 3922 (10am-5pm Tokio time).
If anyone else calls, please share your information here.

Bitstamp's CEO, Nejc Kodrič, claims to have studied Information science and Economics and work experience as a marketing director
MTGox CEO Mark Karpeles has studied nothing, but had work experience in network administration and web development.

Comparing the CEO's, Nejc Kodrič looks far more competent.

Bitstamp is in Slovenia, which is an EU member, MTGox was in Japan.
I trust EU companies more, i've experienced that already with BFL and KNCMiner.

But, if he were locked up, he would be safe and wouldn't need a bodyguard. If his personal wealth would be seized, he wouldn't be able to spend anything.

If the talk is legit: Not including potential investors, because of personal feelings, is again a failure on Marks side to act best for his customers/creditors.

As MT.Gox is now supervised under bankruptcy protection, this could even be criminal, too.

Anyone still got his money back recently? Still waiting for a withdrawal done by the end of January. Should I presume the money is lost?
If mtgox was honest and the delays were due to the banks taking so long, the money would be on the way to you.
If mtgox was lying and they kept the money on purpose, the money is still at mtgox and by now seized.
