Amazon Employee Reports Veiled Threat From Bribery Defendant

(Bloomberg) -- An Amazon.com Inc. employee reported receiving a “veiled threat” from a defendant accused of involvement in an international bribery scheme targeting the online retailer, according to court records.

Jason Noggle, whose LinkedIn profile says he’s head of special projects and investigations at Amazon, said he received an email from Ephraim Rosenberg, a prominent e-commerce consultant based in Brooklyn, New York, and a defendant in the case. Noggle said Rosenberg expressed concern about Noggle’s safety in the email. Under the terms of his pre-trial release, Rosenberg is barred from contacting any defendants or potential witnesses in the case.

Amazon declined to comment. Noggle, identified as a potential witness, couldn’t be reached for comment. He had previous contact with the defendant and hasn’t been charged in the case. Rosenberg couldn’t be reached for comment.

Federal officials in September charged an Amazon employee in India with taking more than $100,000 in bribes to give select Amazon merchants an advantage over competitors selling goods ranging from electronics to dietary supplements. Also indicted were U.S. consultants like Rosenberg who specialize in selling products on the online marketplace. The bribery scheme began as early as 2017 and the perpetrators reaped $100 million worth of competitive benefits, according to the indictment, with hundreds of thousands of dollars in payments criss-crossing the globe via MoneyGram, PayPal and suitcases stuffed with cash sent via Uber. The trial is scheduled to commence in January in federal court in Seattle.

The ring allegedly stole terabytes of confidential company data and devised ways to game the system so some merchants would get more business while their competitors were shut out. Some of the defendants got products removed for safety issues put back on the site, according to the indictment. Shoppers were unaware that their purchasing decisions were being influenced by bribes and kickbacks. For a few hundred dollars merchants could get an Amazon insider to erase negative customer reviews about their products. And $5,000 would buy a “takedown,” in which company consultants conspired to eliminate a competitor from the site by buying its products and leaving negative feedback that they knew would trigger a suspension of the product.

More than half the goods sold on Amazon’s website come from independent merchants who give Amazon a cut of each sale. Amazon has struggled to tamp down various problems that run rampant on the site, including counterfeit products and fake customer reviews meant to deceive shoppers. Many of the schemes are designed to elude detection and include finding online shoppers in Facebook groups, paying them via PayPal to buy a product and leave a favorable review. The federal indictment shows competition is so fierce on the web store that Amazon’s employees and contractors can be enticed with bribes to manipulate a marketplace that’s supposed to help shoppers find the best products at the best prices.

Until now, the bribery case involved only U.S. consultants and former Amazon employees in India. The court documents filed June 16 show at least one consultant interacted with an Amazon employee at the company’s corporate headquarters in Seattle.

Court records also provide new details about how the defendants tried to elude detection. Federal Bureau of Investigation agents in August raided the Acworth, Georgia, home of Amazon consultant Hadis Nuhanovic and seized $100,000 stuffed inside a llama-shaped ottoman in Nuhanovic’s baby’s bedroom. Nuhanovic told investigators the cash, found in stacks of $100 bills packed in vacuum-sealed bags, was a loan to buy dietary supplements he planned to sell on Amazon. The person who provided the money, identified in court documents only as “Client-1,” allegedly paid hundreds of thousands of dollars in bribes to Nuhanovic and other defendants but died before a grand jury returned the indictment.

But today we bring you a new warning, the unsuccessful attempt by Safex to raise money is leading to more desperate measures, leaked information after the Wefunder scam and strategical members of the Safex Scam team leaving is making old investors nervous, Ivana Todorovic and Abraham Dots left and Safex never mention it, the next person about to leave could be the convicted criminal Aharon Bernal who after spending his life dedicated scamming with SAFEX after he left prison he sees no point because he hasn't made any money, he is starting to realise that everybody knows Safex is a scam, so he will probably pursue a career defrauding people in Amazon.

The World Marketplace from Safex is going to get rugpulled, they did some crowfounding some time ago nearly half million dollars,  those investors are about to get rekt.

Daniel Dabek is now reviving the Wrapped Safex Cash scam on Binance smart chain, because there is no bridge between Safex Cash and Wrapped all will be made manually and because the privacy of Safex no one will know how many real Safex the bridge processed,  Daniel Dabek will most probably will increase the price and lower the supply on Binance smart chain to create fake price difference that will make noob investors to believe that this can be an opportunity and eventually they will get rekt when Dabek dump the price.

I don't think joey will fork Safex, the court ordered him to stop using its trademark but to be onest I'm not sure if he can use the source code that is opensource.

I found out that Safex was asking the judge to subpoena Safelaunch.
Safex wrote a 73 page document requesting the court to get all Safelaunch communications.

This 73 page document is asking the court to go over Safelaunch and take everything from them to be analized, I am not sure but I think the court rejected this subpoena, but if it goes ahead it will be probably the biggest search warrant in history more than Trump's Mar a Lago subpoena.

I think Safex is acting with true malice here, 73 pages telling the court to seize everything from Safelaunch, making Safelaunch scared, maybe forcing them to reach an agreement out of court for less than the 20 million Safex is asking.

But luckily Safelaunch is not ceding to Safex and is fighting an injust legal battle because BSCscan refuses to change the name Safelaunch ticker name from SAFEX to SFEX.

If is a smart contract, then why Safex don't sue Ethereum, Binance chain or whatever is running?
Safelaunch actually changed the name of the token from SAFEX to SFEX

I'm 75% confident that Safex will loose this lawsuit and Safelaunch will counter sue and Safex will end up paying millions in compensation.

But if Safex end up winning and get in the hands of 20 million then this can be Daniel Dabek golden ticket, he will have money again, he will use it to travel with his secretaries and take them to expensive holidays once again. I don't think he will return any of the money he toke from Dascoin investors, Orin any of his other scams, I don't think he will pump the price of SFT or SFX.

On March 2, 2022, Safex Foundation, Inc. (“Safex” or “Plaintiff”), represented by Llewelyn Engel of Mcdermott Will & Emery LLP, filed an intellectual property lawsuit against SafeLaunch Ventures Limited and the potential owners and controllers identified as John Doe entities and individuals (referred to collectively as “SafeLaunch” or the “Defendants”), seeking injunctive relief and declaratory judgment, along with damages and other reliefs, for the Defendants’ alleged trademark infringement. This case was filed in U.S. District Court in the District of Columbia with Judge Christopher R. Cooper presiding.

In the complaint, the Plaintiff alleged that, “For the last six years, Safex has been working tirelessly to develop the brand “Safex” in the cryptocurrency industry (the “Safex Mark”). Knowing that it would confuse the cryptocurrency market, Defendant SafeLaunch profited from Safex’s hard work by issuing a competing cryptocurrency called “Safex” (the “Infringing Token”).”

The Plaintiff then alleged that, “Six months before SafeLaunch issued the Infringing Token, this Court enforced the Safex Mark and permanently enjoined a different infringer who similarly sought to call its cryptocurrency “Safex.” Undeterred, SafeLaunch intentionally exploited the Safex Mark to sell millions of dollars’ worth of the Infringing Token.”

The Plaintiff also alleged that, “Using the Safex Mark, SafeLaunch improperly obtained significant market traction. As of the date of this filing, 5,996 separate digital addresses hold the Infringing Token through 120,962 transactions. At its peak, the Infringing Token reached a market cap of $20,000,000. The digital addresses that conducted the largest purchases of the Infringing Token reveal purchases by those digital addresses of at least $13,173,810.”

The Plaintiff further alleged that, “To protect its trademark, Safex sent SafeLaunch multiple cease and desist letters. Despite SafeLaunch’s promise to “rebrand” the Infringing Token to “SafeLaunch,” it has not done so. SafeLaunch refuses to: (a) remove the name “Safex” from the “smart contract” underlying the Infringing Token; (b) take down marketing materials touting the Safex Mark; and (c) change SafeLaunch’s ticker from “SFEX.”

The Plaintiff then alleged that, “Safex incurred both substantial monetary damages and irreparable harm as a result of SafeLaunch’s continued infringement of the Safex Mark and the resulting confusion in the cryptocurrency market [...] Therefore, a customer reviewing the blockchain explorer BscScan page for the Infringing Token and the underlying smart contract would be led to falsely believe that the Infringing Token is actually one of Safex’s cryptocurrencies. This is because the name Safex is identical to the Safex Mark. This is also because the ticker SFEX is just one letter off from the word “SAFEX” and one letter off from SFX, the ticker for Safex Cash.”

There are four claims for relief laid down by the Plaintiff. The first claim alleged is for trademark infringement under the Lanham Act under 15 U.S.C. § 1125(a). The second claim alleged is for common law trademark infringement. The third claim alleged is for unfair competition.
