Not enforceable; see above. To date not a single person has been "fined" under this silly statute. There have been a few shill cases where they portray it as a can-spam issue but it was only mentioned in the PR release and no the cause of action.
A legit business does not resort to spamming because besides the stiff penalties, your site can be reported to your domain registrar for abuse and violation and they can flag your domain and your account, there are legit and proper ways to acquire subscribers, not this way.
