一审法院认为：王某明知对方为不满十四周岁的幼女而实施奸淫，构成强奸罪。王某利用监护被害人的机会强奸被害人，应酌定从重处罚。一审法院以强奸罪判处王某有期徒刑六年，王某不服提出上诉。
王某上诉理由为：他没有实施强奸行为，鉴定未检出精细胞，原判认定他犯强奸罪的证据不足；量刑过重。王某辩护人还认为，王某没有强奸意图和性交行为，且没有射精，不构成强奸罪，应以猥亵罪定罪量刑。
二审法院认为：王某明知被害人为不满十四周岁的幼女而实施奸淫，其行为构成强奸罪。王某利用监护被害人的机会强奸被害人，酌定从重处罚。
关于王某及辩护人提出的不构成强奸罪、原判量刑过重的上诉理由及辩护意见，根据相关证据能够证实王某强奸被害人的犯罪事实，王某也多次供认犯罪事实，足以认定，原判根据王某的犯罪事实、性质、情节及社会危害程度，所处量刑并无不当，该上诉理由及辩护意见无事实和法律依据，法院不予采纳。
