It seems that way. I shut my rig down a few hours ago until this mess gets straightened out. If it doesn't then I'll do something else. This launch has been the textbook definition of overpromise and underdeliver.

Because of concerns surrounding the SEC and how it views/will view crypto and ICOs in general. If you allow US-based "investors" and the SEC views your token as a security it may create a lot of additional work to ensure the business is in compliance. If the team/project isn't US-based then the easy thing to do is simply lockout US-based investors and not have to worry about it.
