Mine (7 BTC for 2TH cloudmining) were finally removed from payment address on 26 Sep.

My only payment from cloudmining was 1 Oct.

It will be interesting how BTC is handled as far as refunding customers. US legal precedence in the making.

I imagine on hand funds are limited but BTC isn't.

As a lucky rent-a-minion customer, I also received this today (I did mess with the spacing):

Dear Customer,

We  received an update from the Hosting Team:


Please be advised that currently we are finishing the last
          preparations in our data center, such as setting up power
          lines and testing the hashing hardware.

          Once this are complete we will be able to launch this
          services.

Please take note that will not have 100% coverage of orders for
          hashing; Crrently have around 100 TH/S but we will keep adding
          devices to cover all of the orders, which is around 300 TH/S.

Of course we will starting with the queue on Early orders
          1st. Further announcements will be made soon.

If you were not yet able to share your BTC payment address,
          and/or should you have questions, kindly do so using
          our ticketing system and contact our support.

It was BA direct ("end of queue"). The cost is $172.50 for 3 X-3s. Sharing cost because maybe it will help someone else prepare.

Did anybody else have to pay import duties (I'm US based) for the shipment? I have received a postcard asking me to go dhlmypayment.us

I saw the website but did not enter my information. More scam concerned than anything; never received a tracking number and my store account still says "processed".

Edit: Checked with DHL this is my Black Arrow shipment.

Unclear to me if there is some substory specific to the listing on why it didn't make reserve.

First of all, I really appreciate all these efforts to do something about this.

I have given my info on my 3 BA orders to Bitcz.

I have a couple  questions;
1. Is refusal of delivery necessary for legal standing? (I'm guessing this is a lawyer question).
2. If delivery happens without signature, is that different for the case? If so, what are the recommended actions?

I'm sure Im not the only one who has these questions. I understand the answers may be sensitive and PM material. I understand BA monitors all this, and I understand they have no issues with punishing and tweaking the queue.

They are sitting (yeah they are not plugged in, right) on a batch of X3s until safety issues with PSUs are resolved. I imagine when these ship a sizeable amount of customers who wish to take a legal venue on a late, misrepresented, and to date unsafe product will be facing similar questions.

Unfortunate BA's decision to continue on with Rent-a-minion. Another decision not in the best interest of its customers or its reputation going forward.

Unfortunate. Just requested refund on second of two orders (X3s) due to multiple BA failures. Sent some info to Bitcz, we will see what materializes there.

I will probably do the HKCC thing this weekend. I guess I am at the point where things suck so bad (safety issues on top of everything else? C'mon) it just doesn't matter. This has gone beyond the pale in so many ways.

Cant believe they made a special "Asshole detected" page.

Received an email last night from BA requesting a BTC address for rent-a-minion. I had requested a refund for the rent-a-minion portion a while ago.

Paid 7 BTC and will be lucky to get two out of it. That BTC is still in the wallet I sent it to.

The email said they are planning to deploy rent a minion in a few days.

Current difficulty returns 6 and change over 6 months if difficulty remains unchanged. My 2 BTC estimate is my estimate, to be fair.

I still have not received a DHL tracking number from their email last week that my shipment should go out later today. I have checked my spam folder many times.

Well you were right, PG, you were right. And man was I wrong.

Any idea on where we can go from here? You seem to have unique insight.

If the HK CC was effective, everyone would be doing it. If legal avenues worked, this would have blossomed to a class action. (Not a lawyer just my observations). BFL is doing the same thing in reality, and is a US based company, and is still for all intents and purposes untouched.

My guess is company realizes if they deliver anything at any time they are off the hook because of location.

Frustrated here and company is non-responsive to an extreme, at least Josh would poke his head out from time to time.

Perhaps this can be written off as an investment loss.

Ref: rent-a-minion.

I have requested a refund and they still have my BTC in the receiving account (check Blockchain.info for yours), not sure why this cant be refunded, it obviously wasn't spent.

There is no way they can build this to get our BTC back. I will wait on my hardware order but obviously this rent a minion isn't standing up until December earliest.

It seems to me they went for a new type of functionality (this was the surprise) and failed. What is left over from this attempt are things like being able to group control the miners. Perhaps this could also explain the amount of time spent on the backplane.

Checked yesterday, if they delivered by last day in Feb I would have had 98 BTC from my purchases.

This is an exercise in losing money gracefully, if there is such a thing. Not sure being in the refund pile is the safest course of action here. I'm actually surprised they are pushing out miners, thought they would have gone hashfast by now.

All BA is doing right now is maneuvering for a good legal position. They have probably examined previous lawsuits against mining companies and are using this information to build as defensible position as possible.

The majority of us will accept their shipments and they will use this fact to be off the hook for further compensation. Most likely this compensation will involve deferred payoff, such as coupons (so we can buy more frustration).

I do think the 50% compensation has a high chance of fruition as lots of us have paid (PSUs) for this already. This would take too much work to undo. The timing of this delivery will be another exercise in batch 1 disappointment.

BA management is trying to figure out how to position the company legally and financially for the post Batch 1 / 2 fiasco. How little they can compensate us and get away with it is the question of the day.

Yes, I am a frustrated customer. No more "Go Black Arrow" from me. I have yet to see any real communication from the very top that wasn't worded vaguely or conveyed any real concern.

Difficulty will be the salt in our wounds as the pre order model gives its last death rattle.

Hopefully they will not compensate with a stupid coupon for our next purchase. But it looks it's now going in that direction...

Its probably what they will go with as it is in their best interest but totally worthless to us.

The compensation announcement is disappointing.

This looks like a legal move, in which they attempt to have customers "accept" the original purchase without their amendments. This, to safeguard against later claims.
