Yes, I'm much more careful with contract deposits now. I'd expect Binance to do the refund though, even if it takes some time.

Thanks for the feedback. That does seem to be the conclusion from all the threads I've searched and read, that there's no way out. It's YoBit, so the funds are lost. I will keep hoping someone will share a solution, but of course, I'm not expecting any.

I don't agree that it's only our fault and Yobit should be absolved of all blame, though.

I have done some searching around and see that this is a common complaint. To get straight to the point, it goes something like this - you made an ETH deposit to YoBit, but it was a contract execution. They will point out that you were warned and that's the end of that.

Fine, we get it, we made a mistake, but the ETH is clearly still in their account. It's not like the funds were lost, or it was sent to an incorrect address or whatever. YoBit still owns the ETH that we sent. It should be refunded - a fine is fair.

My question to everyone who has been a victim of this fraudulent behavior - how did you go about it? Did you have any success? What legal recourse do we have? Any insight on this issue will be useful to many of us.

Update: Coming in 2 months now, pretty much given up. Like I said before, lesson learned. Never again at a shady exchagne.

The dev hasn't sold. They have been distributing tokens exactly like they said they would, all listed in the whitepaper. However, it would be appreciated if the dev is more transparent about the distribution. Also, it would help to only distribute to those that'll actually use it. Right now it seems many are dumping the token instead of using them for retail as intended.
I noticed that there was more then 30 million BAS in sell orders at HitBTC, so more then max supply.

I think HitBTC sold tokens they didnt even had and 1 month later BAS got delisted without ANY notification...

I only can recommend to avoid hitbtc they seems to make scammy things lately

That is bizarre... Haven't heard from ByteCode Team at all in a long while, so until that happens, it's unfortunate to see this once promising project die out

Anyway, we have seen many resurrections in the crypto space, so won't write it off just yet

Thanks, I'll keep at it. It's not really much effort sending them a message every week or so. 99% it's delaying tactics and they have no intention in refunding, but so far they have showed some interest in helping.

Btw, there are so many such posts about Yobit in the Scam Accusations forum that I don't think they care about reputation at all. I knew about this but thought I could quickly get in, buy what I wanted and get out, and it'd be OK. (And for the other deposits that worked, I did exactly that and it was OK) Lesson learned.

Ideally, they should refund it, but because you're also at fault here I doubt they will cooperate that much (it's Yobit we're talking about here). How much you've deposited here? If it's not that much, maybe letting it go is a better option. Use your time wisely, Yobit is famous for its lack of support for some users.
I was making a large deposit in parts, the one that wasn't credited was 18 ETH, unfortunately. If it was a small amount, I would have moved on.

Thanks for the comments, everyone. It's been 2 weeks now, and I'm in contact with them on and off. I can say that at least they are communicating, but progress is very slow. There's some hope they'll refund, but not counting on anything. Lesson learned - I'll stick to the established, customer friendly crypto exchanges. I don't mind much, because this is the first time in 5 years of crypto trading I've lost any tokens, and I'm motivated to make it the last.

By the way, they absolutely should refund. Legally, you are obliged to refund payments if you are unable to tender services. It's not like the ETH is lost. It was clearly diverted to their ETH wallet, and they clearly have access to it. I'm more than happy to pay a fee / fine of course because I fully accept it was my fault. Sadly, with these overseas crypto exchanges, legal recourse is basically out of the question. If anyone has any suggestions otherwise, I'd greatly appreciate it.

Usually, I stay away from shady exchanges, but this time I wanted to buy into a promising project and YoBit seemed like the least questionable option. I tried a test ETH deposit, and then went ahead and deposited from multiple exchanges. Unfortunately, it turns out one of these exchanges made withdrawals through contract execution (I didn't know). YoBit has a warning not to deposit contract, so you can say it's my fault. In fact, that's basically what they replied (to their credit, the reply was quick), that they can't do contract deposits and I should have read the warning. Fair enough, but if they cannot offer a service, should they not refund the money?

The ETH in question has been moved to their YoBit account. They have the money, they can refund it manually or credit it manually. I've been in the crypto game and I know we win some, we lose some, so I'm not complaining. I have assumed I've lost a lot of money, but want to do my best to gain my money back. A Google search (and also here at BCT) tells me that others have faced this issue, and it's an easy mistake to make. So, I'm asking, what did you do about it? What recourse do we have?

Yes, of course, OpenSea has been doing very well using Wyvern protocol. The project was always active, it's just that unlike other projects this one actually does development instead of endless hype... Though tbf it can do with some marketing and PR too.

You can follow on Medium, Discord or Twitter. Not much major activity since the OpenSea integration, but the devs are active and around on Discord. I hold WYV btw, as do many others. It's not unusual for low-cap coins to not have trades for a long time, and then there are bursts of activity as the crypto markets kick into gear.

I had wondered about coinexchange, think I still have some coins there actually.

They had shown some interest in doing a coinswap. Haven't heard any news from them in a while though.

are you sure about this?that was surprising no one can take that large volume within 24hrs well lets what will happen this coming day..

yeah, no one just bought for fun. Huge amount of money, its like kind of investment from a company.
we shall see

These are not companies. That was just regular pump and dump schemes. It's usual fare for crypto, especially low cap coins like BAS are easy targets for pumps and dumps. It's not the first time it's happened, and certainly won't be the last.

The real investors are the ones who are buying now when the price is low, while ignorant traders panic dump.

Is there any level of interest in the original blockchain? Seems there are still quite a few holders of the original coin. I could get a web wallet up for us and maybe kickstart some development for this coin.

Since it's a token swap, technically everyone is still a holder of the original chain. Feel free to kickstart something, though I'd suggest better get involved with the development of the new Wyvern Protocol.

Look forward to the livestream, whenever that's up!

PS: No news from Coinexchange at all?

Seriously, are you guys new to the crypto world? This kind of thing is normal. Happens regularly for low cap coins like BAS. I had told many of you exactly this several months ago - never sell your coin at a low price. Eventually, there'll always be a pump.
