The Colorado Department of Regulatory Agencies is investigating three cryptocurrency firms for promoting unregistered initial coin offerings in the state. The investigations are part of a growing trend of fraudulent companies looking to make quick money. All three firms failed to show up at a hearing to present evidence as ordered by the Commissioner.

Members of the Division of Securities of the Colorado Department of Regulatory Agencies (DORA), and of the state’s initial coin offering (ICO) task force, have been investigating cryptocurrency firms for promoting unregistered ICOs in the state. The task force was set up in May to identify companies or individuals that might pose a risk to Colorado investors.

“As part of an investigation into what has become a trend of allegedly fraudulent companies looking to make quick money,” the agencies announced Monday that “Colorado Securities Commissioner Gerald Rome has signed orders to show cause for three cryptocurrency companies” soliciting to Colorado residents. The announcement details:

The companies that received the orders are Bionic Coin, Sybrelabs Ltd. (also known as Cryptoarb), and Global Pay Net (also known as Glpn Coin and Gpn Token). Previous orders were submitted to Bitcoin Investments Ltd. (also doing business as Db Capital), Estatex, Bitconnect Ltd., and Magma Foundation (also doing business as Magma Coin).

A spokesperson for DORA told news.Bitcoin.com that “the hearing to show cause occurred on Friday, August 24th…and none of the companies listed responded,” adding:

There likely won’t be another hearing. Given that no respondents showed, the Division presented the case to an administrative law judge, who must determine within 2 weeks whether the case made by the Division represents factual evidence. At that point yes, the Commissioner will then issue cease and desist orders.

Bionic Coin
Bionic Coin’s website provides information about an ICO for bionic or BNC, an ERC20 token aimed at enabling “instant payments to anyone, anywhere in the world, and to simplify the purchase of electronic devices and software,” the agencies described. However, “there is no physical address or control person identified on the site.”

Colorado Investigating Three Cryptocurrency FirmsIn addition to promising that “Bionic will grow your money without any effort,” the site lists “supposed media partners such as Forbes magazine, but investigators could not locate any reference to such a company or product on the sites purportedly promoting it.”

The site also attempts to incentivize users to promote the coin by “stating that individuals who post to popular social media sites and blogs will receive up to ten thousand tokens per post.”

Sybrelabs
Colorado Investigating Three Cryptocurrency FirmsSybrelabs Ltd., also known as Cryptoarb, is supposedly located in Cambridgeshire, England. Its website promotes “an investment pool that allows for trading on cryptocurrency exchanges” by using the “cryptoarbitrage robot” tool that allows the firm to “automate many factors occurring with effective arbitrage on several instruments,” the agencies explained.

The company encourages its members to promote the investment pool and recruit other members by providing them with marketing materials and souvenir products. The website also “offers large percentages of profits for minimum participation of $25.00, up to soliciting ‘active investment portfolios’ of $25,000 or more,” DORA wrote.

Global Pay Net
Colorado Investigating Three Cryptocurrency FirmsGlobal Pay Net markets an ICO for glpn coins, “which allegedly provide an international financial platform that is based on blockchain technology,” according to the announcement. These tokens are described as “full-value assets that represent one’s share in the business” and that “investors receive 80 percent of the company’s profits.” The company also offers incentives to promote “the ICO in the form of up to five thousand GLPN coins per social media or online forum post.”

Furthermore, while the company’s website lists multiple cryptocurrency professionals as being involved, two of them have denied involvement. A claim of a filing with the US Securities and Exchange Commission (SEC) also could not be verified, the agencies revealed, adding that there was no business filing in Washington State where the company is supposedly located.

How the world is experimenting with the blockchain

Blockchain technology is beginning to move past cryptocurrencies into companies and now governments. Countries around the world are trialing the emerging technology in areas from recording votes in elections to storing the records of citizens.

Distributed ledger technology (DLT) or blockchain as it’s more commonly known was pioneered by the creator of bitcoin, a digital currency. Bitcoin’s blockchain is a public ledger of activity that stores information about all the transactions taking place on the network. It cannot be hacked or tampered with and it is not owned by a central authority. Instead, a group of participants uphold the network.

CNBC has previously taken a deep dive into how exactly the blockchain works and its use cases in the corporate world. The key part about the blockchain is that it allows several parties that don’t necessarily trust each other, to share a common database that is cryptographically secure. This means that complex processes like contract negotiations could be made cheaper, faster and simpler.

“I think one of the biggest potential promises for governments is credibility enhancement and blockchain at its core. It fundamentally is a way to minimize the degree of trust that is required, and governments all over the world have historically struggled with maintaining wide trust at all points in time.”

Blockchain, which was once viewed skeptically by governments worried about its affiliation with bitcoin and other cryptocurrencies, is in vogue. Experiments are taking place globally into how the distributed ledger technology could be used on a national level. Of course, it would not mimic the bitcoin blockchain, but instead take the principles of a distributed trust-based system and apply it to government processes.

DLT is still in its early stages and there are still many problems to overcome before scalable government-level uses of the technology can be seen. CNBC takes a look through how blockchain is being used by governments.

State-backed cryptocurrencies

Given blockchain first began with bitcoin, it’s a natural next step that nations would begin thinking about their own digital currencies. Several countries have talked about state-backed cryptocurrencies but exactly how they work or what they will look like is still up for debate.

Venezuelan ‘petro’

The first country to actually introduce a state-backed cryptocurrency is Venezuela. It’s known as the “petro” and was launched earlier this year in a bid to raise money amid economic meltdown and sanctions.

Venezuelan President Nicolas Maduro says the digital currency is backed by oil and it raised $735 million when it was first released. And in the latest attempt to save the country’s economy, Maduro devalued the Venezuelan bolivar and introduced a new fiat currency known as the “sovereign bolivar,” which will be backed by the petro.

But the petro does not trade, unlike most other major fiat currencies, and it has been called a scam by experts and illegal by Venezuela’s own parliament. It may seem odd for a country to introduce its own cryptocurrency, but Maduro’s comments in August highlight the motivation.

"They've dollarized our prices. I am petrolizing salaries and petrolizing prices … We are going to convert the petro into the reference that pegs the entire economy's movements," he said.

Venezuela would like to see the dominance of the U.S. dollar depleted and Maduro said last year that the country would like to “free” itself from the greenback.

But Venezuela's attempt at a state-backed cryptocurrency might not be the route for others to copy, according to Jeff Schumacher, CEO of BCG DV, an investor in blockchain start-ups.

"State-backed cryptocurrencies in regimes like Venezuela will do nothing to stimulate economic recovery. Whether standard or crypto, any currency needs to be backed on the fundamentals of the underlying economy," Schumacher told CNBC by email.

"Venezuela's economy is in shambles and creating a crypto will not change that. Most people won’t value it because they don’t believe in the government or the economy. History will inevitably repeat itself and we will likely see Venezuela's petro collapse."

‘De-dollarizing’

China and Russia are among the nations that have talked about state-issued digital currencies. Others include Turkey, Qatar and Iran. The similarities between them include being reliant on the U.S. dollar, as well arguably having somewhat authoritarian regimes.

Cryptocurrencies are seen as a way potentially to reduce reliance on the greenback as well as have more oversight into where money is moving.

“Digital currencies may help a number of countries who are looking to de-dollarize to do that,” Hileman said.

“Cryptocurrencies, with their autonomy could offer a more independent and trusted alternative to the U.S. dollar, especially if they have backing of strong assets in terms of oil or gold in the early stage before they get a degree of stability where they don’t need that,” he added.

But Hileman said it was unclear how these state-backed digital coins would work. They could be issued by a central bank and backed by an asset at the start, just like Venezuela claims its petro is.

It’s not just the more authoritarian nations looking into state-backed cryptocurrencies either. Others like Singapore are testing a way to use a digital version of the Singapore dollar for cross-border payments. Swtizerland’s government has also commissioned a study into the possibility of an “e-franc.”

A state-run bitcoin?

It may be a mistake to call state-run digital currencies “cryptocurrencies” because they may not necessarily run on a blockchain. Instead they could be digital versions of a country’s fiat currency.

"No one's in a rush to get this done. Will it therefore be necessary for it (blockchain) to be part of a digital currency if central banks issued it? Well the answer is I think not," Stephen Poloz, governor of Canada’s central bank told CNBC in January.

This would be a big difference from bitcoin which is based on a blockchain and is decentralized. On the other hand, state-backed digital currencies would be issued by a central authority, perhaps a central bank.

Other uses of blockchain

Blockchain technology offers the promise of more efficient and accurate processes because of how it works. And for governments that is exciting given the amount of data that they hold on citizens and how they are pushing to digitize much of that. Nations are also responsible for a massive amount of record-keeping which could move to the blockchain.

Let’s a take a look at some key trials of blockchain technology in government.

Voting

Elections are susceptible to fraud and human error. Blockchain has been touted as a solution to fix that. A number of trials have happened around the world. One of the most recent happened during West Virginia’s primary election in May. Select votes could use a blockchain-based mobile app to vote. It was created by a company called Voatz.

So how did blockchain voting work in this situation?

People voted via a mobile app which was essentially the equivalent of a ballot paper. The mobile ballots are “tokens” or potential votes which are cryptographically tied to a candidate. The voter makes their decision, it is verified by a number of different servers or computers known as “validating nodes.” Upon verification, the token or ballot paper is debited from the voter’s ledger and put on the candidate’s ledger. This is an automatic process and means that a single person cannot vote twice. And it’s now on a blockchain that cannot be tampered with.

Credit checks

China has been cracking down hard on cryptocurrencies and ICOs, but it has been focusing heavily on DLT. Earlier this year, Chinese President Xi Jinping said that blockchain has “breakthrough” applications.

Parts of the Chinese government have been working with blockchain firms in various areas such as credit scoring. One of those companies is Points which has partnered with a subsidiary of China’s Ministry of Industry and Information Technology and the China Academy of Information and Communications Technology to create blockchain solution for know your customer (KYC) and credit scoring.

The KYC product removes the need for institutions to repetitively conduct the process manually.

“With its partnership with the Chinese government, Points has access to verify ID and criminal records on 1 billion people in China. Thanks to Points’ blockchain protocol, the normally time-consuming KYC process which would normally be done manually, increases the efficiency for institutional partners,” founder Sarah Zhang told CNBC by email.

“It does this by reducing the institution’s need to store data on their own servers as Points because they can simply verify identities or other relevant information through blockchain that has already been verified before.”

This process could be used all around the world but requires data to be opened up to allow verification of a person’s identity and their credit score.

Supply chains

Supply chains are very complicated with several parties involved across many countries. Goods are passed between various parties and lots of contracts are involved in the process. This is a scenario where DLT has been tested.

At a government level, the U.K.’s food watchdog carried out a pilot using blockchain technology in a cattle slaughterhouse. In the pilot, both the Food Standards Agency (FSA) and the slaughterhouse had permission to access the data. They were able to share information on the supply chain, working off one ledger, rather than various different documents.

Blockchain-based supply chains is something several companies are trying out too.

These are just a handful of examples where blockchain has been trialed with many more in the works.

What next?
Blockchain is without a doubt one of the most-hyped technologies this year with people working in the industry seeing it as a silver bullet solution to many processes, which indeed it may not be. Trials are underway but there’s a long way to go before this becomes mainstream.

A number of competing blockchain platforms from Ethereum to Hyperledger are battling to become the dominant player. But one big problem for DLT is scalability, that is, whether it can work on a wide scale efficiently, which would be crucial for it to be effective at a national level.

Hileman said that with the price of cryptocurrencies rising and falling many developers of the underlying blockchain technology may have taken their “eyes of the ball,” but are now back to creating solutions that may come to market soon.

“We will see further work done in the next 12-to-18 months in testing various scalable solutions that will deliver on the promises we have heard about,” Hileman told CNBC.

“There are questions that have not been answered, but I’m confident they will be. There are smart people with different blockchain designs and one of these will work, several of these will work. Resources are there, brain power is there, it’s just a matter of time and I think we will see major advances in scalability.”

Nicehash Returns 60% of Coins Stolen in the Hack

Nicehash, the cloud mining service that got hacked in December, has returned 60 percent of the stolen bitcoins, according to local media. After the cyberattack last year, the Slovenian company promised to fully reimburse its customers and has been doing it on a monthly basis. The police investigation into the case is still ongoing.

Reimbursements Made on Monthly Basis
Nicehash Returns 60% of Coins Stolen in the HackSlovenia-based crypto-mining pool Nicehash has managed to return 60 percent of about 4,700 bitcoins (BTC) stolen in a hacking attack last year, STA reported. In December, 2017 when crypto prices were heading towards their all-time highs, the missing cryptocurrency was valued at approximately 56 million EUR (~$65 million USD).

The price of bitcoin core (BTC) has dropped from almost $20,000 USD per coin in the weeks following the cybercrime incident to around $6,700 dollars at the time of writing, or almost 70 percent.

Nicehash was hacked on December 6, when its website went down and it was forced to interrupt operations. “Our payment system was compromised, and the contents of the Nicehash bitcoin wallet have been stolen,” the company announced in a Reddit post.

The platform was back online just two weeks after the security breach. Its team pledged to fully reimburse the pool members for their losses. So far, the reimbursements have been made on a monthly basis.

Investigation Going On in Slovenia
Nicehash Returns 60% of Coins Stolen in the HackThe criminal investigation into the case is still ongoing, the Slovenian press agency noted citing representatives of the Ljubljana Police Department. “Information gathering and other activities are still underway and carried out with the help of international legal collaboration,” the police said in a press release quoted by STA.

Slovenian police officials commented that this type of investigations are among the most demanding and lengthy, Total Slovenia News reported. Hackers are usually based abroad and act from different parts of the world, using a variety of techniques to conceal their identity and location.

The Ljubljana-headquartered Nicehash claims to be the “largest crypto-mining marketplace.” The service connects sellers and buyers of hashing power. Buyers rent computing power through its online platform in order to mine bitcoin core (BTC). Sellers have to run the Nicehash mining software and connect their hardware to the pool’s servers. The company was founded by Marko Kobal and Matjaž Škorjanc in 2014.

It’s getting hard to pump and dump Bitcoin

It’s getting hard to pump amid the dump in the $209 billion cryptocurrency market.

At least that appears to be the case when you look at Tether, one of the most-traded digital assets and also one that’s allegedly been used to manipulate the price of Bitcoin. Over half a billion dollars of Tether has been created in August alone, a move that in the past would have often coincided with a rally in Bitcoin, yet the larger cryptocurrency has fallen 15 percent.

The assets moved much more in lock step last year, when Bitcoin hit an all-time high, according to a University of Texas professor whose research showed that “Tether seems to be used both to stabilize and manipulate Bitcoin prices.”

Questions about Tether and Bitfinex, one of the world’s largest crypto exchanges that also shares the same management team, have dogged the virtual currency world since last year, when Bitfinex lost banking relationships yet continued to operate. The U.S. Commodity Futures Trading Commission subpoenaed both firms in December, seeking proof that Tether is backed by a reserve of U.S. dollars, as it claims. British Virgin Islands-based Bitfinex and Tether haven’t been accused of wrongdoing.

To date, $2.8 billion Tether have been issued, according to the company’s web site. The digital currency generally trades for around $1 because each coin is supposed to be backed by $1 of fiat money in a bank. The currency, which started trading in 2015, is pitched as a stable alternative to Bitcoin’s volatility, acting as a haven for crypto investors.

But Tether has also been implicated as a way to move the price at will of smaller digital coins, according to a recent research paper by Chainalysis. Last year, Tether was linked to Bitcoin, Ether and Litecoin about 85 percent of the time, according to the paper. When prices crashed early this year, that correlation fell by an average 93 percent. But between January and June, EOS and NEO maintained a high correlation to Tether use.

“While on-chain transaction activity was in decline for the major cryptocurrencies, traders were still seeing opportunities for profit with some of the newer, lower-volume cryptocurrencies,” according to the Chainalysis paper.

“High volatility for low-volume Tether trading pairs is a typical sign of pump and dump activity,” the paper concluded, in part. “A sudden spike in a particular trading volume followed by an abrupt decline is characteristic of price manipulation.”

Liam Murphy, an outside spokesman for Bitfinex and Tether, declined to comment.

Tether has created $515 million of new tokens this month, according to blockchain data. All of those new Tethers were sent to Bitfinex, the data show. That’s backed up by the Chainalysis report. “After issuance, all Tether passes through the Bitfinex trading platform, Tether’s only direct client,” Chainalysis said. From Bitfinex, about 80 percent of the Tether is then moved to six other exchanges: Bittrex, Poloniex, Huboi, OKEx, Binance and Kraken.

Yet not even more than half a billion in new Tether has been able to affect the price of EOS and NEO in August. From July 30 to Aug. 21, EOS has fallen 37 percent and NEO is down 44 percent, according to data collected by Coinmarketcap.com.

Bitcoin encountered an area of interest at the $7,000 mark on its recent pop higher, which may have been just a shallow pullback from the slide. A continuation of the selloff could take bitcoin to the downside targets marked by the Fibonacci extension tool.

In particular, the 38.2% extension lines up with the swing low at $5,900 then the 50% extension is near the $5,600 psychological support. Stronger selling pressure could take it down to the 61.8% extension at $5,274 or the 78.6% extension at $4,825.70. The full extension is at $4,254.10.

The 100 SMA is below the longer-term 200 SMA on this time frame to confirm that the path of least resistance is to the downside. In other words, the selloff is more likely to continue than to reverse. Price moved briefly past the 100 SMA dynamic inflection point but has since moved back down.

RSI is pointing up, though, so there may be some bullish pressure left. In that case, bitcoin could make another attempt at pushing past the $7,000 area of interest to sustain the rally. Stochastic is also turning higher without reaching oversold levels, indicating that buyers are eager to return.



Bitcoin tumbled after the SEC rejected the bitcoin ETF applications from ProShares and Direxion this week, putting the industry a step back in terms of getting a thumbs up from regulators. Another set of ETF applications are awaiting their ruling next month.

Until then, bitcoin traders could hold out for the actual decision or any indication how it might turn out. Keep in mind, however, that the SEC has reiterated that the applications don’t show sufficient measures to rule out potential price manipulation and fraud, so the rest of the proposals might get similar concerns.

Still, it’s noteworthy how buyers continue to defend the long-term floor around $5,800 to $6,000 so another dip could see a bounce off this levels again.

Every few weeks this summer, bitcoin bulls have gotten a ray of hope from U.S. regulators.

This week, that optimism is coming from the possibility a bitcoin exchange-traded fund, or ETF, will be approved by the Securities and Exchange Commission.

What would be the first-ever bitcoin-based ETF is being decided on by the SEC on Thursday, the deadline according to the Federal Register.

ProShares, which has about $30 billion in assets under management, filed for two bitcoin ETFs in September. The ETFs plan to track bitcoin futures contracts traded on the Chicago Board of Options Exchange and will trade on NYSE Arca, according to the SEC filing. ProShares declined to comment on the status of its application.

Exchange-traded funds track an index or group of assets but trade like stocks. The approval of one could bring in a wave of institutional buyers and, because bitcoin has a fixed supply, theoretically push up prices.

Hunter Horsley‏, CEO of Bitwise Asset Management, which submitted its own ETF proposal to the SEC in June, said investors shouldn't read into Thursday's deadline.

"An SEC filing hitting a deadline is a procedural reality — it doesn't change the odds of it getting approved, it just draws our attention to it," Horsley said. "Just because we hit the deadline doesn't necessarily give any indication that the SEC has changed its tune."

Struggling bitcoin prices jumped ahead of other SEC deadlines for ETFs this summer. The cryptocurrency rallied 20 percent, above $8,000, in late July on rumors that another ETF, proposed by VanEck, would be approved in August. That decision was later postponed by the agency.

This week, price moves have been more subtle. The cryptocurrency rose roughly 3 percent to a high of $6,858.61, according to data from CoinDesk. Bitcoin is still down more than 50 percent this year and more than 65 percent from its high near $20,000.

Brian Kelly, CEO and founder of BKCM, said investors are getting more cautious and have stopped betting big ahead of these SEC deadlines.

"My view is still [that] this does not get approved tomorrow, but I feel we're making large steps and getting closer to it," Kelly said. "There's a better chance this gets approved than anything else."

One reason the ProShares ETF might be more appealing to regulators is because it's based on futures trading. The agency has cited the lack of regulation in bitcoin exchanges. But bitcoin futures trade on the SEC-regulated CBOE.

ProShares is hardly the only group looking to list an ETF.

In late July, the Securities and Exchange Commission rejected a second attempt by Cameron and Tyler Winklevoss, founders of crypto exchange Gemini, to list the first-ever cryptocurrency ETF on a regulated exchange. The same week, the SEC delayed deliberations on five other bitcoin ETFs filed by NYSE Arca, Inc. Asset manager Bitwise joined the list of hopefuls in July and filed for an ETF that would track a basket of cryptocurrencies.

After the Winklevoss rejection, the agency reiterated its mission to prevent fraudulent or manipulative acts or practices and to protect investors. The agency has repeatedly mentioned the possibility of fraud and manipulation of bitcoin, particularly since this is done in a largely unregulated offshore market.

The financial watchdog emphasized in the Winklevoss decision that the disapproval did not rest on whether bitcoin or blockchain technology had value as an innovation, or an investment.

SEC Commissioner Hester M. Peirce was the lone dissenter in the agency's decision on the Winklevoss ETF. She published an open letter that bitcoin bulls saw as a positive sign for an eventual approval.

"More institutional participation would ameliorate many of the Commission's concerns with the bitcoin market that underlie its disapproval order," Peirce wrote. "I am concerned that the Commission's approach undermines investor protection by precluding greater institutionalization of the bitcoin market."

Vallahi ne kadar amntıklı gelse de aslında mantıksız da gelse grafık grafıktır hani ustunde az kafa yormada fayda var diye düşünüyorum... Grafikler kesin olacak diye bir şey söz konusu değil bunları çizenler yabana atılacak kişiler de değil...
