There is considerable doubt about the start of the mining, yet you give us little to be convinced everything went honest and you didn't mine on another pool before mining on Gigapool, Eligius and Bitminter.
Late penalty fees are for members who did not pay their required hosting fee on time. This did not apply to anyone with their shares on Bitfunder or paid their required hosting fees on time.
