I finally got the summary on how to proceed with the case from the lawyer.

Here it is:


The trial will start in Cagliari (Sardinia) on 12 September and almost certainly will be able to split into some hearings depending on the choices of Armandi’s defense.

Any postponement of the hearing could last a few months.

In the event of procedural problems (such as errors in notifying the defendant), the timing could be further extended.

What could happen:

1) "Plea bargain": The defendant agrees a sentence with the Prosecutor and the Judge accepts the agreement: in this case there will be no reimbursement of damages, but only legal fees.

2) "Abbreviated": The defendant decides to do the trial without witnesses to save time and have a penalty discount. In this case the injured parties have less of a chance to prove the damages suffered, but in the event of conviction they can get compensation.

3) "Debate": The defendant chooses to run the full trial. In this case all the injured parties who want to get compensation must come to Italy to testify and explain to the judge what damage they have suffered. The process in this case will last longer and, in the event of a conviction, the civil parties will be able to obtain compensation.

What does it mean to get compensation (number 2 and 3)?

If Armandi is convicted, the judge can establish that Armandi must immediately pay at least some of the damage in favor of the civil parties (injured parties). The judge could also say that the compensation will have to take place after Armandi's appeal. Legal fees are never refunded before the second degree. It could also happen that the Judge condemns Armandi, but tells the civil parties that the quantification of compensation must be deferred to a civil judge. In any case, even if Armandi is sentenced to pay, it is not said that he will pay on his own initiative. The sentence can be executed only if he has a salary, or owns a saving or checking account, real estate, other assets or the shares of a company.

How can Armandi be condemned for damages?

You must be a civil party by the beginning of September.

Only people who have been damaged in the Labcoin project in 2013 can ask the Judge to take up the role of civil parties (injured parties) into the trial.

Anyone wishing to establish himself as civil party must sign a special power of attorney in Italian before the lawyer in Italy, or before a notary (or a diplomatic agent at a Consulate or an Italian Embassy abroad).

The text of the power of attorney will be sent to the interested party directly by the lawyer via e-mail. The notary's authenticity must be in Italian, or translated by the notary himself or by an official translator in Italian. The original document must be sent in original by post to the law firm by mid July.

The costs of authentication, translation and mailing of the deed must be beared by the party willing to establish himself as damaged party in the trial.

What are the legal fees for the establishment of a civil party and participation in the trial?

 A)     Just virtualspade

Indicatively the total cost for the participation of a lawyer ("honorary") representing virtualspade is 4,000 euros for the entire duration of the first degree of judgment (hypothesis No. 3).

To this sum must be added the costs of air transfer to Cagliari to be quantified in about 500 euros if the trip can take place in the day, or in 800-1000 euros if the trip involves the need to stay in the hotel.

B)      virtualspade + 1

In the event that other people establish themselves as civil parties in addition to virtualspade, it will be appropriate to involve a second defender representing the other damaged shareholders. It can be assumed that the total costs of two lawyers are 8,000 euros (if the people who make up are two).

C)      virtualspade + many others

To the sum defined at point B) must be added 700 euros for each additional civil party that want to be added to the trial.

In this way, if you wanted to constitute 50 people, the total cost would be 41,600 euros (equal to 8000 euros + 700 euros x 48 people) which, divided equally, would involve an expenditure of only 832 euros per person (which would reach around 1000 euros including travel expenses).

In the hypothesis 2) the fees will be reduced by 10%, without prejudice to the out-of-pocket expenses.

In the hypothesis 1) the fees will be reduced by 20%, without prejudice to the out-of-pocket expenses.

The above-mentioned fees are understood to include a special tax for lawyers (CPA 4%), but VAT (in Italy equal to 22%) is excluded.

Each client will pay half of the fees due by bank transfer at the time of sending the special power of attorney.

The remaining half of the balance must be paid by the end of 2018, always by bank transfer.

I will not provide a copy of the document publicly, as it contains personal information,

and the lawyer suggested that I don't share the document.

But for you dexX7, I could share it with you, for verification purposes and also to satisfy

your curiosity in the case. But I'll need to check that with the lawyer first.

To my knowledge Alessio has nothing to do with our complaint, as he was not in it as a suspect.


As for Albertos whereabouts, I can only speculate. But after reading the news about his drug bust,

and reading some about Italian drug laws, he could be in prison now.

He was busted with 300 grams of marijuana with intent to sell, so not so good for him.

If I remember he had some prior cannabis thing also.


I couldn't find any information about if they got any bitcoins in his bust, so who knows if there is any BTC to get back.

Yes dexX7, it's true Alberto will go to court for the Labcoin complaint we made.

I got a copy of the official document from the Public Prosecutor stating that our complaint is going to court in September this year.

I didn't know about the drug bust that happened before, and I have no information about that.

I'm still here, I don't have any news about the case, but here is what we know now.

- The complaint was recived by the Pubblico Ministero (the Public Prosecutor) on 17.02.2014

- Alberto Armandi is under Preliminary investigation according to the Italian Code of Criminal Procedure

  for the offenses referred to in penal codes 640 c.p. and 494 c.p.
 
  Article 640 Penal Code: Fraud
 
  Article 494 Penal Code: Impersonation
 
- We will be informed when the Preliminary investigation is over, and the results of that, e.g dismissal or move to a trial

About the Preliminary investigation

Not sure if that helps, but thats what I got at the moment, so I guess we will just have to wait for now.

I asked that question also, here's the answer I got:

Neither the Police or Public Attorney is giving out any information about the case.

So we are waiting for them to finish their investigation.
I'm sorry that I don't have any better news to give out at the moment.

Anyone got wallet installed in Debian or Ubuntu?

I got the first 2 errors fixed, but cant get past 3 error, Im not on my wallet computer right now so I cant paste the error messages, but If anyone got it working on any linux please tell me how.

vcm is terminal mode only miner, everything is done by ssh connection or locally in terminal, openbox is installed but nothing else at the moment, right click on desktop to get the menu and start a terminal.

The installer asks what gpu drivers and amd-app you like to install during the install, it also asks what miner you like to install and asks to edit the miners conf file during miner install.

Everything works with the scripts that I made, from first boot to mining, first you need get the first install script from the web server with wget and run that, after that you just need to answer the questions the installer makes, type boot-2 after first reboot and then boot-3 after second reboot. then type cgminer to start mining and sc to connect to the screen session that cgminer is running in.

There is probably many things that could be done better in vcm, and it still needs may more scripts to be a fully functional farm mining OS and Manager, but you got to start some were I guess.

I'm doing all the work on vcm in my free time, and I'm not a real coder or anything so don't expect me to make vcm in to a full farm manager any time soon.

Next things I'm going to add is more amd drivers to the installer and finishing the VCM/PXE server installer and it's functions, atm ~ 70% ready.

Suggestions for improvement and comments about vcm are welcome, all the scripts and files are here:

To get started make your own persistent debian usb or  download a image I made

at first boot switch to root terminal:

This thread is not meant to be a support thread for vcm, You'll find me at freenode irc in #vcm if you have support questions.

I'm posting this because maybe some of you miners are interested in customizing your mining OS, and this gives you a base for doing that.

Of course, the ready vcm images I make will work almost out of the box, you just need to install the miner you want, from miner menu, press mm and enter.

vcm is not meant to be a mining OS for beginners at the moment, not because it's difficult to install, thats easy, but when adding your own scripts and getting the farm manager functions to work you are probably going to need to know some more than just windows OS stuff.

And on that note I'll just say, that all questions about how to do anything vcm related on windows is going to be unanswered by me, I have 22 computers and none of them are running windows, so thats out of my league.

Here is the update about the case that so many people have been waiting for.

In Italy is now pending a criminal investigation against Alberto Armandi for the facts pertaining the Labcoin operation.

Fabrizio and Alessia Tatti's position in the case is under scrutiny by investigating authorities.

Since we filed the complaint our lawyer has had one meeting with the Public Attorney associate head office and one phone meeting with the police officer handling the investigation.

At the first meeting Public Attorney Office got interested in the matter and stated that they will do a thorough investigation, he also gave us free hands to call upon the police officer who handles the case with any new information we may stumble upon.

In the second meeting over the phone, the Police confirmed that our assertions contained into the criminal complaint has been confirmed, and stated that Alberto is currently living abroad.

The Police have asked us to help them in tracking Albertos activities on the internet, so everyone keep your eyes open for any posts or other activities that Alberto does, please contact me with any information you may have.

Thank you for visiting and writing about us! You forgot to mention the coffee and cookies!

Here are some comments to your post:

We have been running beta cards for about a week now without problems, however we have had to take the setup down to do some hardware and software updates.

About the chassis: we have been working with our chassis supplier and cooling systems subcontractor. The cooling inside the chassis is set up so that the mining card coolers are constantly pushing out the hot air and the frontal fans are there only to supply fresh air. The chassis should not be a problem with overheating.

The user interface is indeed still under development, but it is almost finished (1 or 2 days left). The communication with cgminer will use the standard cgminer API connection, thus it should also work with other cgminer monitor softwares.

Good to see that you have the cooling for the cases figured out, I can imagine that tunneling the air flow trough the case and the miners cooler will be sufficient to keep the case inside at acceptable operating temperatures. Now that I think of it, you mentioned just as I was leaving, that you had done some simulations for the case cooling.

And I figured that the coding part wouldn't take you long to get ready, as you seemed to have a very capable team working on the miners.

I went to check out Noncetech's beta miners in Helsinki today, generally speaking I liked what I saw, I admit I'm not a Bitcoin miner expert but I have some general knowledge about electronics and Bitcoin mining. I started mining scrypt coins about a year ago and I have read a lot of articles about Bitcon mining and mining hardware in the last year. I would say I have pretty good picture about Bitcoin mining in general.

The whole team was there, the coder, hardware guy and the economics guy, everyone seemed to know their stuff pretty well. Also one of the guys has a Chinese origin and speaks Chinese which I would say is a good advantage when you do business with Chinese subcontractors, for the assembly of the miners and so on. All the guys were friendly and in my opinion "down to earth" and none of them were full of themselves. Well that may yet change when they get filthy rich selling all those miners to us, I noticed money can do strange things to good people, I just hope they get rich, and don't turn into the dark side after that... I liked their team and wouldn't mind doing business with them.

They set up 2 miners at the occasion, one was their first test miner the other was one of the "beta" miners. The hardware setup seemed quite basic, just plug in the cables and boot the RasPi, the software side was not not yet that simple, their drivers for cgminer was not yet completely finished, so they needed to manually input some commands ( setting the voltage to the chips ) to the RasPi before starting cgminer.

Their web interface for the miner was not yet finished, so I just got a look at the page layout for the interface. The driver part that controls the fan speed on the miner was not yet fully programmed so the fans were on full speed all the time, and those small fans are quite noisy.

The miners was running in "Turbo" mode hashing around 250GH/s or more correctly they showed in cgminer as 2 x 125GH/s per card, 2 hashing blocks per card. One miner showed a little more HW errors than the others, that was the original first test miner the built, on the "Beta" miners they had made some hardware modifications on the Pcb, and it had less HW errors or none. We calculated the percentage of the HW errors on the original test miner, but stupid me cant remember the exact number, but it was low. As a scrypt miner with Gpu's I'm used to 0 HW errors, if I have HW errors I re tune my rigs so they go away, I was assured that Bitcoin mining with Asic's will produce some HW errors and thats normal.

The components on the Pcb's are of high quality, all critical components are made in USA or Japan, this is for stability and long life of the miner, I agree with the choice for a little more expensive components, as for me a miner has to be production grade, I don't have time to baby sit my miners, they should work 24/7/365.

One thing that I didn't get to see in the 3h visit I made to Noncetech is the chassis for the miners, they have not yet got that from the producer. Well I of course wonder how hot will the chassis get on the inside, with 4 cards running in "Turbo" mode producing 1000w of heat, and 2x120mm fans to get that heat out from there.

I'm no expert, but I don't see any major issues with Noncetech getting their miner shipped within a reasonable time after the Pre-orders start, there is some coding to do, but I would say that the coding is not a big issue. I was told that they have the "assembly line" all ready arranged with a Chinese subcontractor, and they are going to China to oversee the assembly and shipping of the miners. One thing that comes to mind is the chassis, if it needs total redesign, that could cause a small delay. Another thing that they have not done yet is a long term stress test, running a miner more than a day or two, now that I think of it, I should have volunteered to do a 3 week stress test on some of their miners, I'm sure my scrypt rigs wouldn't mind the noise in the garage...

Hello everyone,

I posted a update in the Labcoin Lawsuit thread.


Virtual you should also forward a copy to the Chinese/Hong Kong police being that Fabrizio is in China.

Firstly, The complaint is Italian, I don't think they would accept that, but I guess I could get it translated properly, all I have now is a google translated version I made for my self.

Secondly, I have no idea how things work over there, who is the right authorities to submit it to, does it need to be in Chinese, and who would handle the case over there, ie. does it need to be submitted by a lawyer, when there is more than one person seeking to submit a complaint. I don't think that just emailing it over there would do any good.

Thirdly, Fabrizio and iTec-Pro Limited may be in China, but we are filing a complaint against Labcoin a fictional company run by a fictional Nominee Director (Samuel Noi) of iTec-Pro Ltd, who operated only out of Italy, and really doesn't have any real connection to China and iTec-Pro, except some posts made on a forum that they are connected to each other, look at iTec-Pro's registration information from the HK registration office, you will not find any mention there about Samuel Noi or Labcoin.
I guess the first place were the Chinese Police would need to look for evidence is the Italian Police, that is after they questioned Fabrizio, and they would find out that Labcoin is a Italian fictional company. So I guess its a good thing that the Italian Police will start their investigation into Labcoin now, then when some one files a complaint against Labcoin in China they will have some one to contact in Italy for more information. If needed you can contact me for the direct contact information to the Police office that is handling the Labcoin case.

And I think there is a group who was going to submit a complaint to the Chinese authorities, I haven't heard any thing from them lately, I guess we could work together if they are interested in that. How are things proceeding over there?

Hello everyone,

The criminal complaint against Labcoin was filed on Friday to the Polizia Postale, so now we just wait for the Police to do their work, a process that I guess will take some time.

I got the submission receipt released by Police from the lawyer, and the lawyer said that "They seemed quite interested to the matter.", so I would say thats some good news.

I will of course keep you all updated about the case, but I don't want to give out too much information. I know that most of you would like to see some results in the next weeks, but a more realistic time frame is probably, that we will see some results in the next months or so. 

I would like to thank you for the donations that I got Smiley, I got back the BTC that I used to pay for the missing part of the invoice, plus a little extra. I paid the missing part first, because I wanted the invoice to be fully paid, when the lawyer got the signed complaint, so that he would submit it as soon as possible.

Everyone who is involved must contribute SOME amount of BTC, else they risk the possibility of what that may mean if any of the funds are recovered  Lips sealed

Thank you for the donation, every bit helps right now, I took leave from my work earlier to deal with this case, and I have some bills thats needs to be payed now, so I have to use my coins to pay them. Its a good thing that we have here in Finland these great services, that lets you pay your bills with BTC.

Now I'm just waiting for the lawyer to confirm, that the criminal complaint against Labcoin is submitted to the Polizia Postale. After that we wait for the police to do their work, and find these fraudsters guilty.

Then the next step is to hire a lawyer again, and join the court case against Labcoin, were every shareholder can claim compensation for their losses.

But thats the next step, I'm just happy we have come this far, and with the submission of the complaint, I really feel a weight falling of my shoulders.
