Its not illegal, you have a key thats mean you get full right to use that wallet so the amount of 40BTC is your so just use them all. Or you want to share with somebody is ok. The big question here is how can you get that key in the forum? and the last transaction was 2011 is very weird. Or maybe you get your lucky or after you doing something meaningful so thats a reward

The fact someone leaves their wallet in a table does not give you the right to take money out of it, this is the same he has access to the bitcoin wallet but that does not mean he should take the money just because he can.

Yep just do not touch any of the BTC in thier wallet your not the real owner of it you just see the private key. but not that's means it's your's better not touch it and wait for the real owner to claim every btc they own.
